By now, most privacy and security professionals have heard about the General Data Protection Regulation (GDPR), which is is a regulation in EU law on data protection and privacy for all individuals within the European Union. But in many cases they don’t necessarily understand how and why the new law significantly changes the legal landscape. The law becomes enforceable on May 25th.
Unlike most U.S. laws, which are (a) at the state level and (b) reactive in nature, the GDPR creates a number of individual rights for data subjects, imposes a significant number of obligations on both the data controllers and data processors, and creates a regulatory structure that will start wielding its power in the coming weeks, months, and year. This speech will cover the GDPR and several of its less-discussed aspects.
Randy V. Sabett, J.D., CISSP, is Vice Chair of the Privacy & Data Protection practice group at Cooley LLP. A former NSA crypto engineer, Mr. Sabett’s practice focuses on data security, privacy, licensing and IP. He has managed numerous data breach responses, involving major retailers, financial and health care organizations, and on-line service providers.
Mr. Sabett served on the Commission on Cybersecurity and has been recognized as a leader in Privacy and Data Security in the 2007-2016 editions of Chambers USA. Mr. Sabett is a Board of Directors member for the Georgetown Cybersecurity Law Institute, senior ISSA Northern Virginia chapter member, a frequent lecturer and author, and has appeared on or been quoted in a variety of national media sources.
